Complaint Center Terms of Use

Freshdi provides this service based on the following terms and conditions.

The parties to this agreement are Complaint Center users (hereinafter referred to as “Users”) and Freshdi.com (hereinafter referred to as “Freshdi”).

 

1. Definition

1.1 Complaint Center (hereinafter referred to as "the System") – refers to a software program developed by Freshdi that allows Users to sign in and report suspected transaction disputes, product information violations, etc.

 

1.2 User – refers to any individual or entity who uses the System to submit or respond to complaints.

 

2. Effect of Agreement

2.1 This Agreement includes the contents of this document and any rules that Freshdi may issue in the future for the System. All such rules are integral to this Agreement and have the same legal effect.

 

2.2 By using the System, the User agrees to comply with all relevant rules. Freshdi reserves the right to amend this Agreement and related rules at its sole discretion and will notify Users of changes. If the User does not accept the changes, they should stop using the System. Once published on Freshdi.com, the revised Agreement takes immediate effect. Continued use of the System indicates acceptance of the revised terms. Any new functionality that expands the System’s scope will be subject to this Agreement unless otherwise specified.

 

2.3 Upon accepting this Agreement, it becomes legally binding between the User and Freshdi. The User should read this Agreement carefully. If unclear, the User may seek advice from Freshdi or legal counsel. By clicking the "Confirm" button, the User is deemed to have entered into this Agreement.

 

3. Instructions for Using the System

3.1 When submitting a complaint, the User must provide supporting materials as required by the System, including complaint forms, transaction proof, etc. The User guarantees that all information provided is true, lawful, and accurate.

 

3.2 The User must ensure that their contact information (e.g., email, phone, address) is correct and up to date so that Freshdi and the reported party can contact them. Changes must be immediately reported to Freshdi.

 

3.3 Successful submission of a complaint in the System indicates that the User has followed the required procedures but does not guarantee that Freshdi will accept or process the complaint as requested.

 

3.4 When complaint information meets the required standard, Freshdi will inform the reported company, requesting a response within a reasonable time. Freshdi reserves the right to adjust this response time. If the company fails to respond, Freshdi may impose penalties as deemed necessary.

 

3.5 If the reported company submits a counter-notice within the allowed time, which appears reasonable on its face, Freshdi will forward it to the complainant, who must respond within a reasonable time. If the complainant objects, they may escalate the issue through a dispute process.

 

3.6 Freshdi does not have the responsibility or authority to assess the authenticity or merits of the complaint or counter-notice. Freshdi is not a legal arbiter of business disputes and is not liable for any fraudulent or improper conduct by members.

 

3.7 Freshdi may request additional information related to the complaint at any time. If the User fails to provide the required information in a timely manner, Freshdi reserves the right to dismiss the complaint.

 

4. User Declaration

Users make the following declarations and warranties:

 

Users declare that they have the legal capacity to submit complaints under civil law.

Freshdi provides an online information service platform and is not responsible for determining whether information posted on the website infringes rights or resolves disputes.

The complaint process follows national laws, regulations, and public morals. Users bear full responsibility for any legal violations.

Users agree that Freshdi may disclose complaint-related information, including contact details and supporting documentation, to the reported parties to facilitate complaint resolution.

Users agree not to use System information for purposes other than resolving the complaint.

Users consent to receive emails and communications from Freshdi and its affiliates.

5. Termination of Use of the System

Freshdi reserves the right to terminate a User's access to the System without notice in the following cases:

 

Violation of any term of this Agreement;

Submission of false, illegal, or inaccurate complaint materials;

Explicit refusal to accept a new or amended Agreement;

Any other circumstance Freshdi deems necessary for termination.

6. Post-Termination Provisions

6.1 After termination, Freshdi has no obligation to retain any complaint-related information. Freshdi reserves the right to delete such information after a reasonable time.

 

6.2 Freshdi may take actions against Users for violations that occurred before termination, including retaining or deleting records.

 

7. Change and Suspension to the System

7.1 Freshdi may, at its sole discretion, change or suspend part or all of the System’s functionality without notice to the User.

 

7.2 The User understands that Freshdi may need to conduct regular or emergency maintenance of the System. Freshdi is not liable for any interruptions caused by such activities.

 

8. Intellectual Property Rights

8.1 Freshdi retains all intellectual property rights to the System’s contents, including articles, images, designs, and software. These include, but are not limited to, trademark, patent, copyright, and trade secret rights.

 

8.2 Without written consent from Freshdi, no individual or entity may use, copy, distribute, or modify any System content.

 

8.3 Freshdi reserves the right to pursue legal action for any intellectual property infringement.

 

9. Privacy Policy

9.1 Scope: Freshdi may collect User information, such as IP addresses, during System use.

 

9.2 Use of Information: The information collected is used solely for processing complaints and internal data analysis. Freshdi will not share this information with third parties except as required by law.

 

9.3 Information Disclosure: Freshdi may disclose User information in the following cases:

 

With User’s consent for a specific purpose;

In compliance with applicable law;

To respond to a judicial order;

As otherwise allowed by law.

10. Amendments to the Agreement

10.1 Freshdi reserves the right to amend any part of this Agreement. Changes will be communicated appropriately.

 

10.2 If the User disagrees with any amendment, they may stop using the System. Continued use constitutes acceptance of the changes.

 

11. Notification Delivery

11.1 Freshdi may send notifications via website bulletins, emails, SMS, or postal mail. Notifications are considered received on the date sent.

 

11.2 Users should send communications to Freshdi via the contact details provided on the System.

 

12. Governing Law and Jurisdiction

This Agreement is governed by the laws of Vietnam. Any disputes arising from this Agreement shall be submitted to the exclusive jurisdiction of the courts of Ho Chi Minh City, Vietnam.
